Libby was convicted on 4 of 5 counts for Conducting Executive Branch Business While Republican. Jurors may have been uncertain if he briefly became a Democrat during his FBI interview, which explains the one "not guilty" finding. If you go to National Review Online, you can read, at The Corner, the list of Washington reports--some potential witnesses--known to the juror who was a Washington Post reporter. That talkitive fellow is now blogging about the trial at a non-partisan, apolitical web site. I think the name of it is Huffington Post.

Oh, you mean the prosecution's star witness,Tim Russert's former neighbor who sat in on the jury on the he -Tim Russert-said versus he -Scooter Libby- said case... Yeah, absolutely no bias there....

Perhaps being an attorney himself, Mr. Libby thought he could handle the FBI interview. He needed someone like Bill Bennett's brother to guard him as a dog would a bone.

But Mr. Libby's fundamental mistake is clear. Contrast him with Sandy Berger, who was caught red handed Unlawfully Removing Top Secret Documents While Democrat. Once Mr. Berger was able to get Bill Clinton to confirm his still-valid political party status, it was all understood to be a slap on the wrist misdemeanor. For GOP types, the only truly lawful act may be Dying While Republican. As long as you are not too slow about it, and refrain from asking for fancy stuff like hydration.
